DEFINITIONS

“You” refers to the user of this website and its related services, and as such you have gained the right to use this website by respecting the applicable Terms of Use described in detail below.

Sweet Careers Media INC (“Sweet Careers”) is the exclusive owner and operator of Sweet Careers (the website).

This Terms of Use Agreement (the "Agreement") sets forth the terms and conditions which apply to your use of the Sweet Careers website and all services offered by Sweet Careers. By completing the registration process (either as a “job seeker or “employer”) you are indicating that you agree to be bound by all of the terms in this Agreement. Please print and keep a copy of this Agreement for your records if nesseccary.

Sweet Careers has the right, in its sole discretion, to add to, remove, modify or otherwise change any part of these Terms and Conditions in whole or in part, at any time. Changes will be effective when notice of such change is posted at this Site. Please check these Terms and Conditions (by using the “Privacy Policy/TOS” link) frequently for updates by checking the date of "Last Update" at the top of this document. If any change is not acceptable to you, you must discontinue your use of this Site immediately. Your continued use of this Site or downloading or use of Content from it after any such changes are posted will constitute acceptance of those changes. You agree to review this agreement periodically to be aware of any such revisions.

These Terms and Conditions apply exclusively to your access to and use of this Site and do not alter the terms or conditions of any other agreement you may have with SweetCareers. In case of inconsistency between these Terms and Conditions and any other agreement you may have with SweetCareers, the other agreement shall prevail, but only to the extent of the inconsistency.

ELIGIBILITY
By visiting Sweet Careers.com or accepting these Terms of Use, you represent and warrant to Sweet Careers.com that you are 16 years of age or older, and that you have the right, authority and capacity to agree to and abide by these Terms of Use. You also represent and warrant to SweetCareers that you will use this website in a manner consistent with any and all applicable laws and regulations. You agree that the site may ONLY be used for lawful purposes by individuals seeking employment and career information (Job Seekers) and by employers (Employers) and recruitment companies seeking employees.

PRIVACY OF INFORMATION
The Personal Information Protection Act (“the Act”) regulates the way private sector organizations within Alberta, Canada collect, use, keep, secure and disclose personal information. “Personal Information” means all information about an identifiable individual. Sweet Careers recognizes the importance of privacy and recognizes the sensitivity of personal information received by us in the course of offering our service.

We recognize our professional obligation to maintain the confidentiality of our clients’ information, and recognize our obligations concerning the personal information of all individuals that we collect, use or disclose in our practice. This policy has been developed with those obligations in mind.
Sweet Careers collects personal information from you in order to create your online job seeker or employer profile. Sweet Careers will not use or disclose your personal information for purposes other than those described in this policy.

Sweet Careers may also use third-party companies to provide various services (such as advertising, average time, number of visits, page views and other statistics  about visitors to the site) when you use this website. Targeted advertisements are probably more interesting for you and are more productive for our advertisers. (d) You may not use the Service for any unlawful purpose. If you use this service unlawfully we will pass along all information to law enforcement. We may refuse to grant you an USERID that impersonates someone else, is protected by trade-mark or proprietary law, or is vulgar or otherwise offensive, as determined by us in our sole discretion.
(e) Sweet Careers does not collect, use or disclose your personal information without your consent except where required or allowed by law. We do not send advertising to our members and we do not share you information with third parties.

(g) User Information may also be used to determine appropriate new features, content or services for this site, to provide advertisers and business partners with aggregate but not personally identifiable information about our customers and their preferences, including statistical information about the source of visitors, sales, traffic patterns and use of services.

This Agreement constitutes your agreement with Sweet Careers with respect to your use of the Service. You must agree to abide by all of the terms and conditions contained in this Agreement in order to become or remain an authorized user of the Service.

Your right to use the Service is subject to any limitations, conditions and restrictions established by us from time to time, in our sole discretion. We may alter, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database or content. MONITORING OF INFORMATION
We reserve the right to monitor all advertisements, public postings and messages to ensure that they conform to content guidelines that are monitored by us and subject to change from time to time.

REMOVAL OF INFORMATION
While we do review jobs posted on our website, we cannot and do not review every message or other material posted or sent by users of the Service. We are not responsible for any content of these messages or jobs posted. We reserve the right, but are not obligated, to delete, move, or edit messages or materials. You shall remain solely responsible for the content of jobs posted, employer profile pages, public postings, messages and other materials you may upload to the Service or users of the Service.

TERMINATION OF ACCESS TO SERVICE
We may, in our sole discretion, terminate or suspend your access to all or part of the Service at any time, with or without notice, for any reason, including, without limitation, breach of this Agreement. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity of the Service or the Internet by others may be grounds for termination of your access to all or part of the Service at our sole discretion.

PROPRIETARY INFORMATION
This Site, including all Content, is protected by Canadian and worldwide copyright laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of this Site and to prevent any unauthorized copying of the Content. You agree not to modify, copy or distribute any such information in any manner without first receiving expressed written permission of Sweet Careers or its licensors.

You acknowledge that we are not responsible for the suspension of Service, regardless of the cause of interruption or suspension. Sweet Careers may terminate, change, suspend or discontinue any aspect of this Site, including changing the availability of any features at any time without notice or liability; changing any fees or charges for use of the Site, including instituting new or increased fees or charges for the use of the Site or any other Site-related services (the "Service") or any features thereof; removing, adding, modifying or otherwise changing any Content on or from this Site; or imposing limits on certain features and Services or restricting your access to parts or all of this Site without notice or liability for any reason whatsoever. You are responsible for all usage or activity on the Service by you or other users using your password, including but not limited to use of your password by any third-party.

RESUMES & JOB POSTINGS

Resumes are NOT accessible by employers. The resume you choose to upload is for the purpose of applying to jobs ONLY. Resumes cannot be accessed by employers. Some job postings which are posted on this site allow you to follow links to other sites where you can apply for specific job postings or submit your Resume.

Any Resume or other information of any kind that you provide, including as a part of a job application process, that is outside the control of Sweet Careers will be subject to their practices and their privacy policies or practices. By providing your resume directly to the employer, recruiter, human resources professional or other person, and your Resume will be subject to their practices and their privacy policies or practices. Sweet Careers is not responsible for the privacy policies or practices of such third parties. In such cases, we encourage you to review the third party’s privacy policy.

You may choose to delete your Resume from our records at any time. All personal information destroyed or erased from our records is done so securely with due regard to the sensitivity of the information.

EXTERNAL LINKS

The Service (Sweet Careers.com) may from time to time contain links to other internet sites and resources (external links). Sweet Careers provides these links only as a convenience. These linked sites are not under the control of Sweet Careers. If you use these sites, you will leave this Site. If you decide to visit any linked site, you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses and other destructive elements. You acknowledge that we are not responsible for, and have no liability as a result of the availability of External Links or their contents. We suggest you review the terms of use and privacy statements of such external links (their websites) prior to using them.

As a result, Sweet Careers has no control over the quality, safety or legality of the jobs posted on this site, the truth or accuracy of the listings, the ability of Recruiters or Employers to offer job opportunities to Candidates or the ability of Candidates to fill job openings. You assume all risks associated with dealing with other users with whom you come in contact through the Site.
Because user authentication on the Internet is difficult, Sweet Careers cannot and does not confirm that each user is who they claim to be. MISCELLANEOUS

This Agreement represents the entire agreement between you and Sweet Careers regarding the use of our services and supersedes any other agreement or understanding on the subject matter. This Site is controlled, operated and administered by Sweet Careers from its offices within Canada. Sweet Careers makes no representation or warranty that materials at this Site are appropriate or available for use at any locations outside Canada. If you access this Site from outside Canada, you are responsible for compliance with all local law. These terms and conditions, your rights and obligations, and all actions contemplated by this Agreement shall be governed by the laws of the Province of Alberta, Canada. As a condition of using Sweet Caeers services, each user agrees that any and all disputes and causes of action arising out of or connected with Sweet Careers.com, shall be resolved through arbitration, with such arbitration to be held in Edmonton, Alberta, Canada.

Except as expressly provided in additional terms of use for specific areas of the Site, a particular legal notice, or an additional Agreement, these Terms and Conditions constitute the entire agreement between Sweet Careers and you with respect to the subject matter hereof. Additionally, except where prohibited by law, as a condition of using Sweet Careers.com services, you agree that any and all disputes and causes of action arising out of or connected to our services shall be resolved individually, without resort to any form of class action.

Any cause of action you may have with respect to your use of this Site or which is the subject of these Terms and Conditions must be commenced within one (1) year after the claim or cause of action arises.  If for any reason a court of competent jurisdiction finds any provision of these Terms and Conditions or portion thereof to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.
The relationship of the parties is solely that of independent contractors and neither party shall have any authority to act for or bind the other party. The waiver of any breach or default hereunder shall not constitute the waiver of any other or subsequent breach or default.

FEE FOR SERVICES
In addition to the free services provided on the Sweet Careers.com website, certain services are offered which require payment for service.

PAYMENT – 2CHECKOUT.com
SweetCareers does NOT process credit card information you provide to bill you for goods and services. All credit card payments are processed through 2checkout.com which is an authorized merchant of Sweet Careers.

TERMINATION OF SERVICES FOR NON-PAYMENT
Where payment is required for a service and we are unable to charge your credit card for any reason, we may discontinue any and all service to you either temporarily or permanently.

CANCELLATION & REFUNDS OF SERVICES
You may request cancellation of services of any Sweet Careers service at any time. Where, however, a fee has been paid for a service, all such payments are non-refundable. Where billing for a service is recurring on a monthly, yearly or other periodic basis, the unused portion of the current service period will not be refunded.

MODIFICATIONS
Sweet Careers has the right, in its sole discretion, to add to, remove, modify or otherwise change any part of these Terms and Conditions in whole or in part, at any time. If you do not agree to any modifications, you should terminate your use of the Service. Your continued use of the Service now, or following the posting of notice of any changes in this Agreement, will constitute a binding acceptance by you of this Agreement, or any subsequent modifications.

DISCLOSURE AND OTHER COMMUNICATION
We reserve the right to send electronic mail to you, for the purpose of informing you of changes or additions to the Service or of any Sweet Careers related products and services. We reserve the right to disclose information about your usage of the Service and demographics in forms that do not reveal your personal identity.  If we change our privacy policy, we will notify you.
